Whistleblower protection
Submission of notifications under Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report infringements of Union law („Guideline“).
In accordance with the Guideline, the BUT implements an Internal Whistleblowing System (IWS) for employees of the BUT and persons who become aware of an infringement in connection with the performance of their workplaces and wish to report it through the IWS
Notification - what can be reported in accordance with the Guideline
Notification refers to the transmission of information from an individual about a possible violation of the law of which the whistleblower became aware in connection with the performance of work or other similar activity and:
- which has the characteristics of a criminal offence or misdemeanour; or
- violates EU law or regulation governing the areas set out in the Guideline.
The areas to which the notified infringement must relate are:
- public contracts;
- financial services, products and markets; and prevention of money laundering and terrorist financing;
- product safety and compliance;
- transport security;
- environmental protection;
- radiation protection and nuclear safety;
- Food and feed safety, health and animal welfare;
- public health;
- consumer protection;
- protection of privacy and personal data and security of networks and information systems;
- an infringement affecting the financial interests of the EU under Article 325 TFEU; or
- an infringement relating to the functioning of the internal market under Article 26(2) TFEU, including the protection of EU competition and state aid rules.
Submission of a notification
Notification may be made orally or in writing, or, at the request of the notifier, in person. The notification may also be made anonymously. Certain types of legally protected information are excluded from notification.

Procedure for dealing with notifications
- The competent person must inform the notifier within 7 days that he/she has received the notification. The response must indicate whether the notification will be dealt with or whether it does not fall within the specified areas covered by the Guideline and will therefore not be investigated further.
- Within 30 days, the competent person must inform the notifier of the outcome of the examination.
- The review period may be extended twice by 30 days.
- The competent person must propose measures to prevent future infringements.
- The competent person will keep the notification for 5 years after its receipt.
