Příspěvek prezentuje závěry uvedené v usnesení rozšířeného senátu Nejvyššího správního sodu ČR (dále jen NSS ČR) a navazujících rozhodnutí NSS ČR týkajících se posouzení charakteru penále z hlediska možnosti aplikace čl. 6 a 7 Úmluvy.

English abstract

This paper presents conclusions stated in the court ruling of the enlarged senate of the Czech Supreme Administrative Court and following decisions of this Court relating to the assessment of the nature of the penalties from the perspective of the application of Article 6 and 7 of the Convention.
