Methodology of Expert Activity

Learning outcomes of the course unit

Students will gain knowledge of general approaches to expert problems handling, about organization, management and control of expert activities in the CR and about methods of experts at giving expert opinions with emphasis of management in front of public authorities.

Planned learning activities and teaching methods

Teaching is carried out through lectures that consist of interpretations of basic principles, methodology of given discipline, problems and their exemplary solutions.

Assesment methods and criteria linked to learning outcomes

Exam comprises written and oral part. Students have to gain minimum of 80 % success to advance to the oral exam.

Course curriculum

1. Position of Forensic Engineering among other disciplines, specificity of expert and assessor activity, special competency of expert of Forensic Science - history of forensic expert activity, structure, legal regulation, term of Expert activity.
2. Organisation and management of the expert activities, appointment of the experts (who appoints, conditions, suggestions, selection of persons, verification of conditions, appointment proceedings); dismissal of the experts (who removes, conditions for removal, expert office termination); list of experts (list Z and T, central list Z a T, list of institutes, accessibility of lists), proceedings and control of the expert activities.
3. Expert: listed experts, expert institutes, experts not listed (ad hoc)
Expert acceptance: in a procedure in front of a state authority (choice of the expert, appointment of an expert to submit surveying, assignment of surveying, decision-making at dismissal of the expert, survey expenses, specificities, appointment of an expert in the CPC, appointment of an expert in Civil Procedure ,appointment of an expert in administrative procedure), expert acceptance outside the procedure, agreement between the expert and an organisation/a citizen.
4. Expert opinion (written expert opinion – formal and content necessities, oral expert opinion.
Expert activity – legislative requirements, expert’s confidentiality, duty to hand the opinion in, consultant acceptance, usage of machines, equipment and materials of an organisation, expert activity of the institutes, activities of the ad hoc experts.
5. Expert activity: primary expert operations, technical acceptability of the data, opinion elaboration, expert survey of a file etc.
6. Expert activity – expert activity as an information process, system approach to the expert activity
7. Expert share of securing of evidence- basic concepts of evidence, evidence, evidence in the Civil Procedure, the usual evidence in the CPC, the special rules of evidence in the CPC (confrontation, recognition, investigative experiment, reconstruction and verification on the spot), the general principles of evidence.
8. Inspection of the CPC, investigative and expert experiment (preparation, execution), examination in other types of proceedings, measurement, photography, photogrammetry, film recording, sampling protocol.
9. Application of the rules in surveying, references to the provisions in surveying, teamwork processing surveying, acts after submission of the report (hearing expert opinion on the opposition party add- surveying).
10. Expert opinion in the CCP, Expert Testimony in Criminal Procedure, responsibility of an expert submission of a surveying (criminal liability, liability for damage), revision surveying, surveying defects.
11. Remuneration and reimbursement of expert activities costs (expert fees in proceedings before the state authorities, out of proceedings, institute survey expenses, expert ad hoc., and modification of survey expenses in procedural regulations.
12. Expert experience, equipment for expert services, training of technical experts, enforcement of survey expenses (deadlines, documents, law enforcement).
13. Introduction to specific methodologies of Forensic Engineering.
