Construction Law in Architectural Practice

FA-SP2-KAcad. year: 2020/2021

The course provides students with selected information on valid legal regulations on the practice of certified architect and the relevant relations. Students will learn about practical examples and develop their knowledge of construction law and regulations for planning and building procedure, notification of small structures, building renovation and maintenance works and the principles of state building inspection. It informs about selected topics of construction law, e.g., removal of structures, types of appropriation for construction reasons, and about offences and malpractice in building code.

Learning outcomes of the course unit

  • Students will have the basic knowledge necessary for negotiation of intention with the responsible authorities
  • Students will have the necessary knowledge for representing their clients at building and expropriation authorities.
  • Students will know the basic legal regulations necessary to perform professional activities as an independent architect.
  • Students will know how to apply the procedures of Code of Administrative Procedure.
  • Students will know how to apply the procedures of Building Act for location and permission of structures.

Planned learning activities and teaching methods

The basic form of class is a lecture. At the end of each lecture there is space for discussion.

Assesment methods and criteria linked to learning outcomes

At the beginning of lecture in week 5 and 10, there will be a short test from the study materials (teacher may change the date of the tests due to the nature of the studied topics).
The exam comprises written test.
Classification:
First progress test: 10 %,
second progress test: 10 %,
examination: 80 % of the overall evaluation.

  2. Planning decision process, relevant authorities
  3. Binding legal opinions
  4. Building code, types of applications, acts and decisions by the building authority
  5. Sanctions according to the Building Act, criminal offence act
  6. Implementation decrees of Building Act and granting exemptions
  7. Expropriation Act, system of expropriation authorities, decision making
  8. Internal regulation of Czech Chamber of Architects
  9. Cadastre of Real Estate, entry of ownership right
  10. Code of Administrative Procedure no. 500/2004 Coll., principles of administration procedure, decision making
  11. Civil Code – in rem rights and types of contracts
  12. Public Defender of Rights, liability for damage as in Act no. 82/1998 Coll.
  13. Code of administrative justice

Aims

The aim of the course is to familiarize the students with the basic rules of general administrative procedure, the institutes of review of administrative decisions according to the valid legal regulations in compliance with the Code of Administrative Procedure. To familiarize the students with basic legal regulations necessary to perform professional activities as an independent architect.

Students must take both progress tests.
